Apple's standard end-user licence applies to every App Store download; these terms add what is specific to this game.
These terms cover your use of the Bumplings™ game app, made by Layne Verbeek, an individual developer in Ontario, Canada ("I", "me", "my"). By downloading or playing Bumplings™, you agree to them. If you do not, please do not use the app.
I grant you a personal, non-exclusive, non-transferable licence to install and play Bumplings™ on devices you own or control, for your own private enjoyment.
You may not copy, sell, rent, redistribute, reverse-engineer, or attempt to extract the source code or assets of the game, except where the law expressly allows it regardless of what these terms say.
The game, its characters, artwork, music, sound, and name are mine and are protected by copyright and trade-mark law. Playing the game does not give you any ownership of them.
Prisms are the in-game currency. Hearts, boosters, and anything else you earn or buy inside Bumplings™ are in-game items. Please note:
In-game items are a licence, not property. You do not own them. You have a limited right to use them inside Bumplings™, and that right has no value outside the game.
These items have no real-world value. They cannot be exchanged for money, sold, traded, gifted, or transferred to another person or another account.
These are stored on your device. If you delete Bumplings™, your Prisms and progress are deleted with them. Prisms are what Apple calls a consumable purchase, which means Apple's "Restore Purchases" cannot bring them back — not because I have chosen not to, but because consumable purchases are not restorable by design. If keeping your progress matters to you, keep the app installed.
I may change how they work. Prices, pack sizes, earn rates, and what items do can change as the game is updated and balanced.
All purchases are made through Apple's App Store, and Apple is the seller. Prices are shown before you confirm and are charged to your Apple Account. Refunds are handled by Apple, not by me. I cannot issue, approve, or reverse a refund. To request one, use Apple's process at reportaproblem.apple.com. If a purchase is charged but the Prisms do not appear in your game, tap Restore purchases in the Store first: it asks Apple to finish any purchase that was paid for but not delivered. If that does not fix it, contact me and I will do what I can to help.
Please do not use Bumplings™ to do anything unlawful, and do not attempt to cheat, tamper with, modify, or interfere with the game or with other people's use of it.
I may update the game, change features, or stop supporting it or particular devices at any time. I may stop distributing it altogether. I will try to give reasonable notice of anything major, but I cannot promise the game will always be available or will always work on every device or iOS version.
To the fullest extent the law allows, Bumplings™ is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. I do not warrant that the game will be uninterrupted, error-free, or free of defects.
To the fullest extent the law allows, I will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost in-game progress or items, arising out of your use of Bumplings™.
Where liability cannot lawfully be excluded, my total liability to you is limited to the greater of the amount you paid for in-app purchases in the twelve months before the claim, or CAD $50. Nothing in these terms limits any rights you have under consumer protection law that cannot be limited by agreement.
Apple is not a party to these terms and is not responsible for Bumplings™. Apple has no obligation to provide support for the app.
These terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law rules. If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protections of your own country.
